Incentive Terms and Conditions

• These are the terms and conditions related to an Incentive being operated by Liberis (as defined below) for merchants (i.e. Businesses) in the United Kingdom and the United States. This Incentive is subject to the following provisions:

  1. In these terms and conditions and any related marketing or other material, ‘Liberis’ refers to Liberis Limited (Company No. 05654231) in respect of merchants in the UK, and Liberis US, Inc. (Company No. 7203441) in respect of merchants in the US.
  2. This Incentive is open to all UK and US merchants.
  3. This Incentive offers a 10% discount to be applied to the fixed fee associated with the Business Cash Advance (“BCA”) product (“Incentive”). For example, if you successfully apply for a BCA amount of £20,000 and you are quoted a fixed fee of £4,000. The 10% discount will be applied to the fixed fee, resulting in discounted fixed fee of £3,600 (i.e. £4,000 minus £400).
  4. Details of the Incentive will be sent by email to Eligible Merchants, and Eligible Merchants must take advantage of this Incentive within one week of such email having been sent in order to receive the 10% discount on the fixed fee (“Eligible Merchant”) .
  5. There is no cash alternative to the 10% discount.
  6. Liberis reserves the right, at its sole discretion to withdraw, suspend, or amend this Incentive at any time without prior notice.
  7. Insofar as is permitted by law, Liberis, its agents, employees or representatives will not in any circumstances be responsible or liable to compensate merchants who utilize this Incentive for any loss, damage, personal injury or death occurring as a result of taking up the Incentive except where it is caused by the negligence of Liberis, its agents, employees or representatives. Your statutory rights are not affected.
  8. There is no payment required to qualify for the Incentive.
  9. Liberis reserves the right to not provide the Incentive if it has reasonable grounds to believe that there has been a breach of these terms and conditions or a breach of a customer contract or any illegal or criminal activity including fraud in connection with this Incentive.
  10. Eligibility for the Incentive does not automatically qualify you for a Business Cash Advance. Amounts advanced are subject to status and our underwriting process before any offer can be made.
  11. Liberis will process your personal information as set out in the Privacy Policy.
  12. For UK merchants, the terms and conditions shall be governed by and shall be interpreted in accordance with the laws of England and Wales. The parties submit to the exclusive jurisdiction of the courts England and Wales.
  13. For US merchants, the terms and conditions shall be governed and interpreted under the laws of the state of Delaware. The parties submit to the exclusive jurisdiction of the courts Delaware.
